HomeMy WebLinkAboutORD NO 404 SECTION 1. It shall be unlawful for s~ay person, firm, corporation
or association to eng~age in, conduct, carry on or maintain th8 business
of givil~ public dances within the City of .Bakersfield, either as owner,
agent or mans~er, without first having procured a permit from the
Council of the Cit~ of Bakersfield to so do.
SECTION 2. Applications for said permits shall be made on forms to
be furnished by the City Clerk and shall be signed by the person or
persons to whom said permit shall be issued, and shall state the nsme ~
or names of the owner or agent of the ha~l or place where said public
~ance is to be held; the location of same; the the n~e of the person
who shall be the manager and have charge of same, and such other in-
for~nation as the City Council may from time to time direct.
SECTION 3. Said pez~nit shall be granted only to such person, firm,
corporation or association as the Council of the City of Bakersfield,
after investigation, shall find to be proper and suits~ble persons to
eng_~age in, conduct, carry on and. ~aintain said business. Said permit
shall be accepted by the app~$cant therefor subject to the re,mas of
this Ordinance and to such other rules and regulations as m~yaa.t .any
time be adopted or~ enacted by said Council, and to the investigation
and surveillance of the Chief of Police, who may, if he thinks it ad-
visable reqmire a special police officer to be in attendance at said
dance hall or place, at all times; said police officer to be pard for
by the person, firm, corporatioo or associ~tti,ion, but whose duties shall
be preseribed by said Chief of Police.
SECTION ~. Said pemit when issued shall authorize the holder there-
of to give, conduct, carry on and n~intain a public dance at the place
designated, and shall be issued for a period not exceeding ~
months, and. may be r6voked at any time by said City Council when it is
sho~ to the satisfaction of said Co_uncil that said public dance or
public dance hall or place is being conducted and. nzintained in an
improper and unlawful manner.
SECTION %. Whenever the public dances'provided -for in this Ordinance
are carried, on, conduct and maintained in any open-air structure or
place, the application for said permit provided for in Section 2 of
this Ordinance, must, in addition to the other matter con'rained therein
be ~ndorsed by /~ .property owners or residents
residing within ~ blocks from the place where said public
dance is to be given, carried, on, conducted and maintained.
SECTION 6. Any person, firm, corporation or association, their
a~ent or manager, failirqg, refusi~gor neglecting to perform any act
require5 under this Ordinance, or violating any of the provisions con-
tained herein:, shall be guilty of a misdemeanor and upon conviction
thereof shall be punishable by a fine not to exceed. Three Hundred Dol-
lar~ ($300.00) or by imprism~ent in the County Jail· for a period not
to exceed. Ninety (90) days, or by both such fine and imprisonment.
