Section $. Mo woeden building now within the limits prescribed in the first section of this ordinance, whic~may be damaged ~r destroyed by fire or otherwise, to the extent of fifty per centumof the value thereof, shall be repaired or rebuilt, nor shall any such building when the damage to or destruction thereof as aforesaid ia less than fifty per centumof its value, be so repaim~- e~ or rebuilt as to enhance the value of smch building over w~at'~'~$ the same was lr~ior to such partial damage or destruction, or so that such building shall occupy any g~eater space, or be of any larger dimension than before such damage theret? or partial destruction thereof. Any person who shall violate the provisions of this sec-, tlon shall~ on conviction thereof, be punished by a fine of not less than one hundred dolla~s.-and not more than two hun~red.Zdotlars, or by imprisonment in the county Jail of the County of Kern at the rate of one day'for each dollar of said fine. Section 5'. The amount ~ extent of damage that may be done to any building or structure shall, for the purposes of this ordinance, be deZermined by three disinterested persons, residents of this city, and free-holders or house-boulders therein, one of which shall be selected by the owner of such building or structure, another by. the President of the Bc~.rd of Trustees of this city, and the chief of the fire department shall be the third, In the event that the owner of such building shall neglect, fail or refuse to appoint such disinter~sted person as hereinbefore provided, for ~lt~e space of three days after he has been notified so to do by the Boa.rd .... o~ ~i~e~'5f-'Shld CitY, By ~Otide in wri'ting, either served upo~ him personally or left with the agent of said owner or person in possession of said building or structure, as said Board of Trustees may elect, then and in that case, the Board of T~mstees of said City may ~hemselves appoint a second disinterested person as hereinbefc~*e provided. A ~eolslon of a ~aJorlty of the con,nitres or per~.or~ named shall be in writing, slgn~i by the persons rendering said decision and filed with the city clerk, and said decision shall be final and conclusive on the question of_val~e afores~aid. ' '" Section,s. Any person Uwho shall be conviote~ erecting, placing, repai~i~ ~r rebuildi~ ~wo~en buildi~ or etruct~e within the ~view and meaning and-in , violation of the provisions of this ordinance shall, within five days after such conviction, cause such wooden building or st~ct~e fo~ the ~rection, const~ction, placing, repairin~ or rebuilding of which he s~ll ~ve been convicted as aforesaid, to be removed, and on his fail. e, neglect or re~sal so to do, for each day that said fail. e, neglect or re~sal shall thereafter centime, it shall be a separate offense, and if convicted thereof such person shall be p~ished by a fine of not ~ess than twenty dollars nor more th~ one h~ed dollars, or by impressment in the co~ty Jail of the cowry of xe~ at the ~te of one day f.o~ each dollar of said fine.
