Minutes of the regular meeting of the Council of the City of
Bakersfield, California, 1held in the Council Chamber of the City Hall
at eight o'clock P.M. July 7, 1952.
Present: Carnakis, Saunders, Smith, Shurley, Sullivan, Vanderlei, Vest

Minutes of the regular meeting of June 30, 1952 were read
and approved as read.
Reception of communication from Civil
Defense Office e~closing statement made
by Secretary of the Air Force to
immediately activate the Ground Observor
Corps. Matter referred to City Manager
as Civil Defense Director.
Upon a motion by Carnakis, seconded by Saunders, communicatiDn
from the Civil Defense Office enclosing statement-made by the Secreta:ry
of the Air Force to immediately activate the Ground Observer Corps
on a 24 hour basis was received and ordered referred to the City
Manager, who is Civil Defense Director of the City of Bakersfield.
Approval of report from Director of
Public Works on positions occupied by
emergency appointees.
Upon a motion by Shurley, seconded by Saunders, report from
Director of Public Works advising that in accordance with Section 5
of Emergency Ordinance No. 936 New Series, G.
Superintendent of Streets and J. A. Hathaway,
Associate, are employees of the Public Works

the residence qualifications of the City Charter, was approved.
Approval of report from Recreation
Department on position occupied by
Emergency Appointee.
Upon a motion by Saunders, seconded by Smith, report from
Recreation Department advising that in accordance with Section 5 of
Emergency Ordinance No. 936 New Series, Harold Aguirre, Male Supervisor
in the Recreation Department does not meet the residence qualifications
of the City Charter, was approved.

report.
Upon a motion by Smith, seconded by Shurley, petition from 31
residents of the area requesting the installation of Stop signs at
intersection of Beale Avenue and Flower Street was referred to the Chief
of Police for investigation and report~
Acceptance of bid of Walter Mortenson,
Inc. to furnish Public Liability
insurance coverage for 1952-53 fiscal
year.
Upon a motion by Shurley, seconded by Carnakis, upon
recommendation of the City Manager, bid of Walter Mortenson, Inc. to
furnish Public Liability insurance coverage for fiscal year 1952-53
for a premium of $26,000.00 was accepted.
City Auditor authorized to transfer
unliquidated encumbrances of 1951-52
to the 09 Accounts Payable fund.
Upon a motion by Smith, seconded by Vest, the City Auditor was
authorized to make the following transfers of unliquidated ~ncumbrances
for 1951-52 to the 09 Accounts Payable Fund:

21 Park Fund
22 Recreation Fund
25 Capital Outlay Fund
31 Traffic Safety Fund
32 Motor Vehicle License Fund

City Manager authorized to advertise
for bids for leasing 2500 acres of
the municipal farm for five year period
with option to renew for additional
five year period.
It was moved by Carnakis, seconded by Shurley, that the City
Manager be authorized to advertise for bids to lease 2500 acres of the
municipal farm at the expiration of the present lease, for a period o:~
five years with option to renew for an additional five years. Substi~ute
motion was made by Saunders that the City Manager be authorized to
negotiate with the present lessee for a new lease on the municipal farm.
The motion died for lack of a second. The original motion carried
unanimously.

Allowance of Claims.
Upon a motion by Carnakis, seconded by Saunders, claims
as audited by the Finance Committee were allowed, and the City Auditor
was authorized to issue warrants on the City Treasurer to cover the
respective amounts.
Adjournment.
Upon a motion by Vest, seconded by Carnakis, the
Council adjourned.

Upon. a motion by Shurley, seconded by Vest, the Council

Acceptance of Clerk's certificate
that no written protests or objections
were filed in the matter of Public
Improvement District No. 690 and oral
protests having been presented, action
on confirming as.sessment in the matter
of Public Improvement District No. 690
was held over one week.
The certificate of the Clerk that no protests or objections had
been filed was received, however, oral protests were presented by Mr.
Stump, 139 Oakdale Drive, end by Mr. Woods, ].27 0akdsle Drive, which
objections were considered and on motion off Camskis, seconded by Smith,
action on confirming assessment in the matter of Public Improvement
Distr~[ct No. 690 was continued for one week and the matter of the
complaints was referred to the City Engineer to see that corrections

agreement between the City of Bakersfield and the County of Kern was

the services of a structural
engineer to make a survey of the
City Hall build~n~.
Upon a motion by Shur]ey, seconded by Smith, the City Manag,~r
was authorized to retain the services of a structural e~gineer to
make a survey of the City Hall building, at a cost of $80.00 per d~y.
City M~nager's plan for removal of
offices from the~south wing of City
Hall was approved and authority given
to make the necessary moves.
Upon a motion by Shurley, seconded by Csrnakis, the City
Manager was given authority to have the Auditor, Treasurer and
Assessor offices moved to the Central M~re Station, the Police
Dep~rtment to the build~n~ located at 17th and L Streets, and the
C~rk to the office now being used by the Fire Marshal in the City
Hall, at a cost of eoproximately $8,000, which shell include t~e
cost of erectin~ temporary partitions at the fire station, and such
other incidental cost of moving.

Upon a motion by Vest, seconded by Camskis, the Council meeting
adjourned, and reconvened in Room 201 of the Kern County Court House.
The minutes of the regular meeting of the Council of the City
of Bakersfield, California, held in the Council Chamber of the City
Hall st eight o'clock P.M., July 21, 1952, were read and approved.
Opening bids for Municipal Sewer
Farm Lease.
This being the time set to open bids for a lease on the Municipal
Sewer Farm, the b~d received was op~ned, examined and declared. Upon
s motion by Saunders, seconded by Shurley, the bid was ~eferred to the
Cit~ Manager and to the Council for conside~etion and future action.
Saunders was appointed to act as Chairman of the committee to study
lease.
Acceptance of b~d of Duncan Meter
Company to furnish 1680 parking
meters.
Upon a motion by V~nderlei, seconded by Shurley, the bid of the
Duncan Meter Company to furnish 16~0 parking meters was accepted and
all other bids rejected. Mr. Camskis voted a~a~nst this motion.

Upon a motion by Carnakis, seconded by Saunders, Emergency
Ordinance No. 946 New Series amemdizg Section I of Ordinance No. 280
to provide that on and after the 28th day of July, 1952, the regular
weekly meetin~ of the Council shall be held in Room 201 in the Kern
County Court M6use, was adopted as resd by the following vote:

Upon a recommendation of City Manager Gunn and Councilman

Farm for a five year period, with option to extend the terms an additional
five years, and the City Attorney was instructed to prepare the lease

they responded during the emergency caused by the earthquakes.

Manager was authorized to remove the damaged portion of the Clock Tower
which is unsafe and a hazard to the public.

City Manager authorized to reserve
certain items from the damaged City Ha~l
for preservation in Kern County Museum.

was authorized to grant the request of the Kern County Museum to
set aside the old vault doors, some of the iron yard fence and

of findings of fact from the Planning Commission recommending denial
of the petition was read. All persons present were given an opportunity
to be heard. After hearing all arguments both for and against the
rezoning of the area~ it was moved by Carnakis~ seconded by Shurley~ that
the recommendation of the Planning Commission be rejected~ and the Council
vote to rezone the area to an R-2 District and permit the Housing
Authority to proceed with the construction of the low rent housing

The Council of the City of Bakersfield, by Resolution No. 51-52
and Emergency Ordinance No. 950 New Series, adopted on the 2nd day of
September, 19~2, called and provided for the holding of a special election
within said City on November 4, 1952, for the purpose of submitting to the
qualified voters of said City the following proposition:
Shall the City of Bakersfield incur a bonded
indebtedness in the principal sum of $950,000.00
for the acquisition and construction of a certain
municipal improvement, to wit: a City Hall
together with the acquisition of all apparatus,
appurtenances, furnishings, equipment, and other
properlty, both real and personal, necessary thereforT'
By said resolution and by order of this Board of Supervisors,
said special elect~on was ordered consolidated with the State General
Election held within said City on said date, and this Board was authorized
to canvass the returns of said special election and to certify the resalts
thereof to said Council; and
Said special election was duly held pursuant to said orders
of consolidation at the polling places prescribed for said General election
and the votes cast thereat were canvassed and the returns thereof made
as provided by law; and.
The Board of Supervisors, through a special canvassing Board
appointed by it, duly canvassed the absentee ballots cast at such
special election, and, pursuant to Section 7962 of the Elections Code,
ordered the County Clerk of the County of Kern to canvass all returns of
said special election and said special canvassing board having duly calx-
vassed the absentee ballc~s cast at said special election, and the County
Clerk having duly canvassed the returns of all votes cast at said special
election, all in the same form and manner as provided by law for the
canvass of the returns of said State General Election and the absentee
ballots cast thereat, and results having been certified to the Clerk of
the Board of Supervisors, and said Clerk having entered in the minutes
of this Board a statement of the results of said special election;

City Auditor authorized to pay $15.00
per meeting for use of Carpenter's Union
Hall.
Upon a motion by Carnakis, seconded by Vest, the City Auditor was
authorized to pay $15.00 per meeting for use of Carpenter's Union Hall,
~11-20th Street, by the Council as a weekly meeting place.-

City Attorney instructed to examine
contract between City and Union Avenue
Sanitation District and take necessary
steps to obtain refunds for ad valorem
taxes paid to the County of Kern.
Upon a motion by Shurley, seconded by Carnakis, the City Attorney
was instructed to examine the contract between the City and.the Union
Avenue Sanitation District and take the necessary steps,to obtain a refund
for the taxpayers who have paid the ad valorem tax of 59~ per 100 dollars
to the County of Kern for connection charge.
Adoption of Resolution No. 62-52
awarding the contract for work described
in Resolution of Intention No. 696..
The Engineer of Work, heretofore appointed, reported that he
had tabulated all bids received for the construction of sanitary sewers
in Planz Road and other streets and alleys, known as Public Improvement
Distri~ct No. 696 (Planz Park Annex$, as per Resolution of Intention No.
696, and finds that the bid of Joe D; Miller is the lowest regular
bid submitted for said improvement. Upon a motion by Carnakis, seconded
by Vest, Resolution No. 62-52 awarding the contract to Joe D. Miller at
the prices named in his bid, said bid being the lowest regular bid
submitted for said improvement, was adopted as read by the following vote:

Minutes of the regular meeting of December 8, 1952 were read
and approved as read.
Acceptance of bid of A. Steiert & Sons
Inc. to furnish 4,000 pounds Gutter Broom
Wire. -
Upon a motion by Vanderlei, seconded by Smith, bid of A. Steiert
& Sons, Inc. to furnish 4,000 pounds of Gutter Broom Wire for a total price
of $996.00 was accepted, and all other bids were rejected.
City Manager instructed. to advertise
for Chief Building Inspector.
Upon a motion by Shurley, seconded by Saunders, the City Manager
was instructed to advertise in the Western City magazine and other
publications for a suitable man for the position of Chief Building Inspector,
with the salary to remain open.

Upon a motion by Shurley, seconded by Saunders, report of the
Planning Commission recommending that action on request of Housing Authority
of the County of Kern to fezone four lots on 11th Street between Robinson
Street and Lakeview Avenue be withheld until after the next City election,

In accordance with recommendation of the. Planning Commissior~, the
City Attorney was instructed to prepare a Resolution granting a variance
of Zoning Ordinance No. 501 New Series to Elizabeth Kurm, Louis Benzino
and Edna Benzino, affecting that certain property zoned as an R-3
(Limited Multiple Residential) District to permit the construction and.
operation of a parking lot, located on the south side of First Street
between L Street and Chester Avenue.

and Truxtun Avenue be referred to the Director of Public Works for study
and report to the Council in one week. After discussion, motion was:

any contract may provide for progressive pay-
ment of not more than ninety per cent of the

Upon a motion by Vanderlei, seconded by Shurley, plans and
specifications for the construction of irrigation pipeline on municipal
farm were approved, and the City Attorney ~as instructed to prepare a
Resolution adopting the plans.

week.
It was moved by Saunders, that petition from Mercy Hospital
for cancellation of taxes on all of Block 413B, Bakersfield, together
with improvements and personal property thereon, be granted. The motion
failed for lack of a second. Upon a motion by Smith, seconded by Shurley,
action on the matter was deferred for one week.
City Attorney instructed to prepare
agreement of mutual termination of
Change Order No. 10 with Wonderly
Construction Company. City Manager
authorized to call for bids for the
installation of an alarm and communications
system between the existing and new Sewage
Treatment Plant.
Upon a motion by Carnakis, seconded by Saunders, the City
Attorney was instructed to prepare agreement of mutual termination of
Change Order No. 10 with Wonderly Construction Company for the installation
of an alarm and communications system between the existing and new Sewage
Treatment Plant, and the City Manager was instructed to call for bids
to have the installation made.
City Clerk instructed to direct a
letter to the Kern County Sheriff's
Reserve for services rendered during
earthquake disaster.
Upon a motion by Carnakis, seconded by Smith, the City Clerk
was instructed to direct a letter to the Kern County Sheriff's Reserve
thanking them for services rendered during the recent earthquake disaster.
City Manager instructed to negotiate
through an appraiser for the half block
of property south of Sixteen th Street,
between Chester and Eye Streets.
Upon a motion by Saunders, seconded by Shurley, the City Manager
was instructed to negotiate through an appraiser for the half block of
property south of Sixteenth Street, between Chester and Eye Streets, and
to report to the Council as soon as possible which properties can be
obtained at a reasonable price as determined by appraisals on file,
and which will probably have to be condemned. Councilman Vanderlei voted
in the negative on this motion.
