Present: Carnakis, Morelock, Saunders, Shurley, Sullivan, Vanderlei,Vest Absent: None Minutes of the Regular Meeting of June 25, 1951 were read and approved as read. Acceptance of bid of Hartman R~aterials to furnish 10,000 tons selected Road Materials. Upon a motion by Carnakis, seconded by Saunders, bid of Hartman Materials to furnish 10,000 tons selected Road Materials for 60~ per ton was accepted, and all other bids were rejected. Rejection as excessive of all bids to furnish 1000 tons SC-3 and SC-4 Road 0il. City Manager authorized to go on the open market to purchase requirements. Upon a motion by Saunders, seconded by Carnakis, all bids to furnish 1,000 tons of SC-3 and SC-4 Road 011 were rejected as excessive, and the City Manager was authorized to go on the open merket to purchase at the best possible price, not to exceed $14.75 per ton. Reception of communication from Regional Water Pollution Control Board re requirements governing the nature of the discharge from new sewage treatment plant. Upon a motion by Vanderlet, seconded by Shurley, communication from Regional Water Pollution Control Board regarding requirements governing the nature of the discharge from the proposed City of Bakersfield sewage treatment plant was received and ordered placed on file. City Attorney instructed to prepare Ordinance to amend Sound Equipment Regulation Ordinance No. 848 New Series. At this time Councilman James Shurley, ChaiNman of the special committee appointed by the Mayor to investigate the advisability of amending Ordinance No. 848 New Series to permit the operation of outside sound equipment at drive inns until 10:00 p.M., gave a report of the findings of the committee. Upon a motion by Carnakis, seconded by Shurley, the City Attorney was instructed to draft amendments to Ordinance No. 848 New Series incorporating the recommendations of the Special Committee. 238 Bakersfield, California, July 2, 1951 (Cont'd.) Acting City Manager instructed to install necessary acoustic tile in Council Chamber and purchase sound equipment, total cost not to exceed $1,000. Upon a motion by Carnakis, seconded by Shurley, the Acting City Manager was instructed to proceed with the work of installing the necessary acoustic tile in the Council Chamber and to purchase sound equipment, expense for total installation not to exceed $1000. Councilmen Venderlei and Vest voted in the negative on this motion. Approval of agreement with Kern County Society for Crippled Children for maintenance of society&s lawn at 610-4th Street and Mayor authorized to execute same. Upon a motion by Carnakis, seconded by Saunders, agreement with the Kern County Society for Crippled Children for maintenance of Society's lawn by city's forces at 610-4th Street was approved, end the Mayor was authorized to execute same. Councilman Morelock voted the negative on this motion. Action on adoption of 1949 Uniform Building Code deferred for one week. Appointment of special commatee to investigate and make recommendetions to the Co~ncil. Upon a motion by Carnakis, on adoption of o~dinance adopting the seconded by Saunders, action 1949 Edition of the Uniform Building Code was deferred one week, and a special cormuittee was appointed to study the code and any revisions made by the County and make recommendations to the Council. The Mayor appointed Councilmen Vanderlei, Carnakis and Vest as members of this committee,, City Attorney instructed to draft amendment to Ordinance No. 666 New Series. Upon a motion by Shurley, seconded by Saunders, the City Attorney was authorized to draft amendment to Ordinance No. 666 New Series to provide for the suspension and revocation of Food Handling Per. nits. Bakersfield, California, July 2, 1951 - 3 ,39' Approval of Change Order No. 4 Sewage Treatment Works contract with Wonderly Construction Company. Upon a motion by C~rnakis, seconded by Shurley, Change Order No. 4 to provide for extra compensation of $120.00 to Wonderly Construction Company for installation of telephone lineextension at Sewage Treatment Plant was approved. Acting City Manager and City Auditor granted extension of time to July !6, 1951 to submit annual budget estimate to Council. Upon a motion by Csrnakis, seconded by Vest, the Acting City Manager and City Auditor were granted extension of time to July 16, 1951 to submit annual budget estimate to Council. Acting City Manager instructed to contact head of Kern County Public Works re~arding the possibility of conveying Beale Memorial Library to the County. Upon a motion by Shurley, seconded by Camskis, the Acting City Manager was instructed to contact the head of Kern County Public Works department regarding the possibility of conveying Beale Memorial Library to Kern County for Library purposes. Chief of Police instructed to investigate the advisability of prohibiting heavy truck traffic on "Q" Street off 24th Street. Upon a motion by Carnakis, seconded by Saunders, the Chief of Police was instructed to make an investigation and report back to the Council on the advisability of prohibiting heavy truck traffic from operating on "Q" Street off 24th Street. Upon a motion by Vanderlei, seconded by Morelock, City Clerk's certificate that no protesta or objections were received in the matter of Public Improvement District No. 688 was received and ordered placed on file. Adoption of Resolution No. 36-51 ordering the vacation of alley in Block 168 - Public Improvement District No. 688. Pacina offering to purchase Fire Station #] for $20,000 was deferred one week. Petition from property owners bordering Dolores Street referred to City Engineer for investigation and recommendation. Upon a motion by Shurley, property owners bordering Dolores Street asking repaired, was referred to the City Engineer for recommendation. seconded by Carnakts, petition from that the street be investigation and Approval of classification showing Job requirements, description and salary range for position of Planning Assistant. Upon a motion by Shurley, seconded by Saunders, classific~tion showing Job requirements, description and salary range for position of Planning Assistant as recommended by the Civil Service Commission for Miscellaneous Departments, was approved. City Attorney instructed to prepare an amendment to Salary Ordinance No. 879 New Series covering classification of Planning Assistant. Upon a motion by Shurley, seconded by Carnakis, the City Attorney was instructed to prepare an ~endment to Salary Ordinance No. 879 New Series covering classification of Planning Assistant, to be placed under Schedule No. 24. Adoption of Resolution of Acceptance of Deed for St. Francis School property, designated as Lots 5, 6, 7 and 8, Block 284, Bakersfield. Upon a motion by C~rnakis, seconded by Saunders, Resolution of Acceptance of Corporation Grant Deed from the Roman Catholic Bishop of Monterey-Presno for St. Mrancis School property designated as Lots 5, 6, 7 and 8 in Block 284, Bakersfield, was adopted as read by the followin~ vote: Ayes: Carnakis, Saunders, Shurley, Sullivan, Vest Noes: Morelock, Vanderlei Absent: None 242 Bakersfield, California, July 9, 1951 (Cont'd.) Upon a motion by Morelock, seconded by Shurley, Supplemental Agreement with the County of Kern for maintenance by the City of programs of supervised community recreation was approved, and the Mayor was authorized to execute same. Adoption of Ordinance No. 907 New Series amending Ordinance No. 848 New Series. Upon a motion by Shurley, seconded by Carnakis, Ordinance No. 907 New Series amending Sound Equipment Regulation Ordinance No. 848 New Series was adopted as read by the following vote: Ayes: Carnakis, Morelock, Saunders, Shurley, Sullivan, Vanderlei, Vest Noes: None Absent: None City Auditor authorized to transfer encumbered balances from various funds for fiscal year of 1950-51 to 09 Account. Upon s motion by Carnakis, seconded by Morelock, the City Auditor was authorized to transfer encumbered balances for fiscal year 1950-51 in amount of $133.515.54 from various funds to the 09 (Accounts Payable) Account. Allowance of Claims. Upon a motion by Shurley, seconded by Carnakis, claims as audited by the Finance Committee were allowed, and the City Auditor was authorized to issue warrants on the respective amounts. Adjournment. This being the time set to open bids to purchase pumping unit for Central Park water well, s nd no bids having been received, upon a motion by Camskis, seconded by Shurley, the City Manager was authorized to go on the open market to purchase the pumping unit. Acceptance of bid of John W. Pactna to purchase Fire Station ~3 for the sum of $20,000. Upon a motion by Shur!ey, seconded by Morelock, bid of Dr. John W. Pactns offering to purchase Fire Station #3 for the sum of $20,000 was accepted. City Manager authorized to negotiate the transfer of title to Fire Station to Dr. John W. Facina. Upon a motion by Shurlsy, seconded by Morelock, the City Manager was authorized to negotiate the transfer of title to Fire Station #3 to Dr. John W. Pacina. Action on preparation of resolution establishing prevailing rate of wages for certain crafts effective July l, 1951 deferred one week. Reception of report from Police Chief recommending that heavy truck traffic should not be prohibited on "Q" Street between 24th Street and 99 Highway. Upon a motion by Vanderlet, seconded by Carnakis, report from Police Chief Grayson advising that in his opinion heavy truck traffic should not be prohibited on "Q" Street between 24th Street and 99 Highway, was received and ordered placed on file. ~ City Attorney instructed to prepare ~ ordinance adopting the 1949 Edition of the Uniform Building Code. Upon a motion by Carnakis, seconded by Saunders, recommendation of special Council Committee was approved, and the City Attorney was instructed to prepare ordinance adopting the 1949 Edition of the Uniform Building Code. Reception of City Treasurer's Financial for June, 1951. Upon a motion by Carnakis, seconded by Morelock, the City Treasurer's Financial Report for June, 1951 was received and ordered placed on file. Appointment of Joseph L. Toole as Member of the Planning Commission. IRon a motion by Carnakis, seconded by Saunders, the Mayor's appointment of Joseph L. Toole as member of the Planning Commission to fill vacancy created by resignation of Alfred Glantz, was approved. Action on applications of Bakersfield Transit Company to Public Utilities Commission for authority to reroute portions of certain bus lines tabled for one week. Upon a motion by Carnakts, seconded by Shurley, action on applications to the Public Utilities Commission from the Bakersfield Transit Company for authority to reroute portions of certain bus lines was tabled for one week, to enable Mr. Mickelberry to appear before the Council and discuss the proposed changes. Upon a motion by Shurley, seconded by Morelock, Ordinance No. 908 New Series amending Subsection (a) of Section 8 of Ordinance No. 879 New Series by adding the classification of Planning Assistant, was adopted as read by the following vote: Ayes: Camskis, Morelock, Saunders, Shurley, Sullivan, Vanderlei,V~st Noes: None Absent: None Adoption of Zoning Resolution No. 14 denying variance of Zoning in a limited multiple district to permit the use of a residence for the care of alcoholics. Upon a motion by Camskis, seconded by Shurley, the Purchasing Agent was authorized to advertise for bids for approximately 4000# of Hickory broom fibre, 3000# Palmyra broom fibre, and 2500# of steel wire, covering six months supply of sweeper material. Purchasing Agent authorized to purchase fire alarm equipment installed by Gamewell Company. Upon a motion by Shurley, seconded by Camskis, the Purchasing Agent was authorized to purchase fire alarm equipment installed by G~mewell Company under options to purchase, in contracts dated May 26, 1947, December 3, 1948, and October 10, 1950. City Auditor authorized to issue warrant to Artukovich Bros. for payment on outfall sewer. Upon a motion by Vanderlei, seconded by Morelock, the City Auditor was authorized to issue a warrant in amount of .~57,286.83 to ^rtukovich Bros. covering 5th progress payment on outfall sewer contract. Approval of amendment to agreement for maintenance of State Highways dated June 19, 1950. Upon a motion by Morelock, seconded by Shurley, amendment to agreement for maintenance of State Highways dated June 19, 1950 was approved, and the Mayor was authorized to execute seme on behalf of the City. City Attorney instructed to study request for resolutio~ Protesting against lock-out of employees in present telephone company strike. A representative of the traffic department employees of the telephone company appeared before the Council asking that s resolution be passed protesting against a lock-out of employees during the present strike, and upon a motion by Shurley, seconded by Morelock, the City Attorney was instructed to study the matter and report back to the Council. City Engineer instructed to request State Department to Highways to place directional signs on state routes in vicinity of Union Avenue. City Engineer instructed to report on condition of Myrtle Street sewer main to Council. Communication from Police Chief requesting that Police Department be reimbursed for dyeing of present uniforms referred to City Manager. Upon a motion by Saunders, seconded by Carnakts, communication from Police Chief Grayson requesting that the City reimburse police officers for expense of dyeing present uniforms from forest green to blue, was referred to the City Manager to be brought to the attention of the Council at budget time. ~. Material Company which represented a penalty for paying employees less than the prescribed prevailing wage rate, was referred to the City Attorney, and the City Auditor w~s instructed to withhold this amount pending further investigation. Reception of invitation from Bakersfield Chamber of Commerce for Council to participate in Kern Gounty Fair Parade. Upon a motion by Carnakis, seconded by Morelock, invitation from Bakersfield Chamber of Commerce to Council to participate in Kern Co~nty Fair Parade to be held Monday, September 24, 19~1, was received and ordered placed on file. Reception of communication from A. L. Hilderbrand, Fresno, regarding hearings before the Public Utilities Commission re application of P. G. ~ E. Company for increase in gas rates. Upon a motion by Csrnakis, seconded by Shurley, communication from A. L. Wilderbrand, Commissioner of Finance, Fresno, advising that the hearings before the Public Utilities Commission in regard to the application of the Pacific Gas and Electric Company for an increase in gas rates have been concluded, was received and ordered placed on file. In response to s request from California Building and Construction Trades Council, upon s motion by Morelock, seconded by Carnakis, the City Attorney was instructed to prepare a Resolution establishing prevailing rates of wages to be paid certain crafts on all public works, effective July 1, 1951. City Manager instructed to investigate protests and City Attorney instructed to advise Public Utilities Cormmission that City wishes to file protest regarding application of Bakersfield Transit Company to reroute and/or abandon portions of certain bus lines. Upon a motion by Saunders, seconded by Camskis, the City Manager was instructed to investigate protests against application of Bakersfield Transit Company to Public Utilities Conmission for aut'hority to reroute and/or abandon portions of certain bus lines in the Cit'y. The City Attorney was instructed to notify the Public Utilities Commission that the City wishes to file a protest against the abandoning of certain routes. Adoption of Ordinance No. 909 New New Series adopting a uniform Building Code for the City of Bakersfield and repealing Ordinance No. 682 New Series and all amendments thereto. Petition from Rol~ert N. Eddy for rezoning of ares oD the south side of East CaIifornia Avenue between Owens Street and Cottonwood Road to permit construction of low rent housing project referred to Planning Commission. Upon a motion by Csrnskis, seconded by Saunders, petition from Robert N. Eddy, architect, for rezoning of area on the south side of East California Avenue between Owens Street and Cottonwood Road to permit the construction of low rent housing project, was referred to the Planning Commission for ~nvestigation and recommendation. Approval of amended specifications for classification of Chief Building Inspector submitted by Civil Service Commission for Miscellaneous Departments.
