Contract awarded Bakersfield Garage and Auto Supply Company to furnish. one 1940 Dodge Bros. Deluxe Sedan for the Police Department. This being the time set to take further action on proposals submitted covering the proposed purchase of one Sedan type Automobile for use in the Police Department and a full and complete investigation having been made with respect to the merits of all automobiles offered, particularly pertaining to the adaptability of the automobiles for the purpose for which they will be used, it was determined by the Council that the proposal submitted by the Bakersfield Garage and Auto Supply Company offering to furnish one 1940 DodEe Bros. Deluxe Sedan for a net price of $830.06 was the lowest responsible bid submitted. Therefore, upon a motion by Marmaduke, seconded by Smith, the propossl submitted by the Bakersfield Garage and Auto Supply Company was accepted, and all other bids rejected. Action on petition from Southern Pacific Company for franchise to maintain and operate a spur track across and along James Street deferred until January l~, 1940. This being the time set to further placed by the Southern Pacific Company for a maintain and operate a temporary spur track across and along James Street, a protest submitted by J. R. Dorsey against the granting of the permit was read, and upon a m~tion by Boden, seconded 'by McMillan, the protest was received and ordered placed on file. Upon a motion by Boden, seconded by Smith, the City Treasurer's Financial Report for the month of December, 1939 was received and ordered placed on file. Petition from Kern County Fire Wardens to make sewer connection to County owned Mt. Vernon sewer line referred to City Attorney for legal opinion. A petition submitted by the Kern County Fire Wardens requesting permission to make sewer connection to the County owned sewer line at the corner of Mt. Vernon and Niles Streets was read, and upon a motion by Pauly, seconded by Smith, the matter was referred to the City Attorney for a legal opinion as to whether or not the City Council can waive the connection fee as provided in County agreement. Adoption of Resolution urging Chief of Engineers of United States Army to submit Kern River Flood Control report to Congress. Upon a motion by Boden, seconded by Sollers, a Resolution urging the Secretary of War and the Chief of Engineers of the United States Army to submit Kern River Flood Control Report to Congress at the earliest possible date for consideration was adopted as read by the following vote: Marmaduke, McMillan, Pauly, Smith, Sollets, Wilson Ayes: Boden, Noes: None Absent:None Allowance of Claims. Caster sskinz for a hearin~ on the denial of the City ~anager to grant him s permit to operate a taxi cab was read, and upon a motion by Smith, seconde~ by ~c~illan, the hearin~ was set for eight o~clock P.,~., January 99, 1940. Matter of advisability of holdinff a ball to provi4e funds for Christmas street decorations and to provide a float for Pasadena Rose Tournament Parade taken under consideration. Er. Robert J. Hodson, Secretary of the Bakersfield Chamber of Commerce, appeared before the Council and suggested that arrangements be made to hold a Mayor's ball during the year to provide fun4s to furnish Christmas street decorations, and also Bakersfield, California, January 15, 1940 (Conttd.) to provide a float to be entered in the Pasadena Rose Tournament Parade January 1, 1941. Upon a motion by Pauly, seconded by Smith, the matter was taken under consideration. Thirty day's extension of time granted Sam Fingerhut to complete installation of automatic traffic signals at 19th Street and Union Avenue. Upon a motion bF Pa~ly, seconded by ~armaduke, Sam Fingerhut was ~ranted a thirty dayts extension of time from January 17, 1940 to complete the installation of automatic traffic signals at the 19th Street-Union Avenue intersection, subject to the approval of the bonding company. ~atter of petition of Southern Pacific Company to construct spur track across and alonff James Street laid on the table. Permission granted State Division of Highways to purchase and install speed limit si~ns and charge same to Bakers- field allocation of ~/4~ Gasoline Taxes for State Highways. Upon a motion by Sollers, seconded by Smith, permission was ~ranted the State Division of Highways to purchase and install the necessary ~umber of speed limit signs within the incorporated limlts of the City of Bakersfield and to charge same to the Bakersfield city allocation of 1/4~ Gasoline Taxes for State Hi~hwa.~r s. Approval of S.R.A. a~reement covering removal and trimmin~ of trees on City properties. Marmaduke, McMillan, Pauly, Smith, Sollets, Wilson of the Regular Meeting of January 29, 1940 were read and approved as read. Reception of City Treasurer's Financial Report for January, 1940. Upon a motion by Boden, seconded by Sollets, the City Treasurer's Financial Report for the month of January, 1940 was received and ordered placed on file. Petition to close alley in Fractional Block 177, Godey Tract, referred to Planning Commission. Upon a motion by Smith, seconded by Sollets, a petition submitted by Henry and Mary Eissler asking that the necessary proceedings be undertaken to close the alley running east and west in Fractional Block 177, Godey Tract, was referred to the City Planning Commission for recon~endation. Letter from Kern County Building and Construction Trades Council filed. A communication from the Kern ~ounty Building and Construction Trades Council advising that on and after February l, 1940, no member of the Kern County Building and Construction Trades Council will be allowed to work on any W. P. A. building and construction jobs within the Jurisdiction of the Council was read, and upon a motion by McMillan, the communication was received and ordered seconded by Smith, placed on file. Petition for installation of automatic traffic signals at intersection of 24th Street and Chester Avenue received. A petition signed by a number of proprietors of business establishments in the vicinity of 24th Street and Chester Avenue asking that steps be taken to install automatic traffic signals at that intersection was read, as also was a recommendation from the Bakersfield Chamber of Commerce to make the installation. Upon a motion by Marmaduke, seconded 123 Bakersfield, California, February 5, 1940 (Cont~dl.) by Boden, the matter was referred to the Traffic Division of the Police Department for recommendation. City Auditor authorized to issue warrant for ~50.00 to J. Carruthers for ten foot easement for sewer purposes. Upon a motion by Sollets, seconded by Smith, the City Auditor was authorized to issue a warrant for $50.00 to J. Carruthers as consideration for a sewer easement of the east ten feet of Lot 13, Block 4, Laguna Square, the warrant to be delivered on receipt from J. Carruthers of a properly executed easement to cover. Allowance of Claims. Upon a motion by McNillan, seconded by Sollets, claims as audited by the Finance Committee were allowed and the City Auditor was authorized and instructed to issue warrants on the Treasurer to cover the respective amounts. City Attorney to prepare ordinance prohibiting the dumping of water or rubbish in gutters. Upon a motion by ~armaduke, seconded by McNillan, the City Attorney was instructed to prepare an ordinance prohibiting the dumping of water or rubbish of any description in gutters. City Attorney to prepare ordinance amending Section 7 of License Regulation Ordinance No. 512 New Series. Upon a motion by Boden, seconded by Smith, the ~ity Attorney was instructed to prepare an ordinance amending Section V of License Regulation Ordinance No. 512 New Series by eliminating the last four lines of the Section. City Clerk to advertise for bids to acquire by removal of street car rails on portions of 8th, llth and "P" Streets. Minutes of the Regular Meeting of February 5, were read and approved as read. Hearing set on application of Edward L. Butterfield for permit to operate taxi cab. 1940 An application having been presented by Edward L. Butterfield asking for a hearing before the Cotmcil on the matter of denial by the City Manager to issue permit to operate taxi cab, upon a motion by Smith, seconded by Sollers, the hearing was set for eight o~clock P.M., ~onday, February 19, 1940. Mayor authorized to execute deed to J. G. and Helen E. Carruthers for portion of Lot 13, Block 4, Laguna Square with reservations. Upon a motion by Boden, seconded by Smith, the Mayor was authorized to execute a quit claim deed to Joseph G. and Helen E. Carruthers for the north thirty feet of Lot 13, Block 4, Laguna Square, with reservations. City Attorney authorized to execute stipulation - Case No. 30~972 before Superior Court of Kern County re Pacific Telephone and Telegraph Company vs. City of Bakersfield. Upon a motion by Boden, seconded by Sollets, the City Attorney was authorized to execute a stipulation extending time to plead Case No. 30,9V2 before the Superior Court of Kern County, the Pacific Telephone and Telegraph Company vs. City of Bakersfield. Fifteen day's extension of time granted Griffith Company to complete improvement of Sumner Street at Union Avenue. Upon a motion by Smith, seconded by McMillan, the Griffith Company was granted a fifteen dayrs extension of time from February 15, 1940 to complete the improvement of Sumner Street at Union Avenue, subject to the approval of the bonding Company. 126 Bakersfield, California, February 13, 1940 (Cont'd.) Adoption of Ordinance No. 558 New Series amending Section 7 of Business License Regulation Ordinance No. 51~ New Series. Upon a motion by Sollers, seconded by Smith, Ordinance No. 558 New Series amending Section 7 of Business License Regulation Ordinance No. 512 New Series was adopted as read by the following vote: Ayes: Boden, McMillan, Noes: None Absent: Narmaduke, Pauly, Smith, Sollets Wilson Adoption of Ordinance No. 559 New Series prohibiting the dumping or throwing of water, leaves, rubbish, etc. in public streets or gutters. Upon a motion by Sollers, seconded by McMillan, the City Attorney was instructed to prepare the proper resolution to authorize the Tax Collector of the Cotunty of Kern to dispose of seventy nine pieces of property deeded to the City of Bakersfield for delinquent taxes and Public Improvement Assessments. McMillan, Pauly, Smith, Sollets, Wilson Minutes of the Regular Meeting of February 13, 1940 were read and approved as read. Denial of City Manager to grant Taxi Cab permit to Edward L. Butterfield sustained. This being the time set for hearing in the matter of application placed by Edward L. Butterfield for a review of the action of the City Manager in denyin~ a permit to operate a taxi cab and Butterfield not being present, upon a motion by Pauly, seconded by Boden, the action of the City Manager in denying the permit was sustained. City Manager authorized and instructed to dispose of street car rails on por- tions of 8th, llth and "P" Streets. This being the time set to open bids for street car rails on portions of 8th, llth and "P" Streets and no bids having been received, upon a motion by Boden, seconded by Sollers, the matter was referred to the City Manager for disposition. Matter of maintaining stables without permit referred to the City Manager. A complaint h~ving been presented to the Council relative to the maintenance of stables without a permit as provided for in Ordinance No. 106 New Series, upon a motion by Pauly, seconded by Smith, the matter was referred to the City Manager for investigation. Adoption of Resolution authorizing Kern County Tax Collector to sell 79 Pieces of property deeded to the City for taxes and Public Improvement Assessments. Deputy City Attorney John Shortridge advised that the California Vehicle Code governs the traffic on highways and the matter should be taken up with that body. Mayor Wilson announced that the Council will ask a survey of the conditions by the endeavor to have the zones posted with the proper traffic State and signs. This being the time set to further camsider bids to furnish One 1/2 ton truck for the Park Department, u~on a motion by Marmaduke, seconded by Sollers, proposal submitted by Geo.Haber- felde, Inc., offering to furnish One Ford V-8 truck for the net amount of ~660.00 was accepted and all other bids rejected by the following vote: Ayes: Boden, Marmaduke, Smith, Sollets. Noes: ~c~illan, Norris. Absent: None. Griffith Company Granted E~tension of Time to complete improvement of Bridges on ~Oth Street. Upon a motion by Boden, seconded by Norris, the Griffith Company was granted an extension of thirty working days time to complete the bridges at the KernsIsland Canal, Mill Ditch, Eastside Canal and 30th Street, subject to t~e approval of the bonding company. ?etition to Reduce alley in Block 364, Bakersfield. A petition signed by t~ree property ov, mers in Block 364, Bakersfield, ss~ing that the width of the alley be reduced from 33 to 20 feet was read and upon a motion by Smith, seconded by Norris, same was referred to the City Planning Commission for recommendation. Upon a motion by Karmaduke, seconded by Smith, the City Clerk was instructed to advertise for bids to furnish One Heavy Duty Gasoline Driven Eleetric Welder for the Street Departr~ent. Resignation of Geo. E. Wilson as President of the Cotmcil and 1Jsyor of the City. Upon a motion by Bo~en, seconded by Sollers, the resignmtion of Mr. Geo. E. Wilson as president of the Comacil and Mayor of the City was accepted with regret. Mr. Wilson vacated his seat at this time and requested cotmcilman Boden to take the chair as presiding officer. Fred S. Boden Appointed President of the Cotuncll and Mayor of the City. Upon a motion by Sollers, seconded by Marmaduke, Mr. Fred S. Boden was ~manimously appointed president of the Council and ~ayor of the City of Bakersfield. Adjournment. Upon a motion by Smith, seconded by So!!ers, the Council adjourned.
