Resolution of Intention Ordered Pro- posing to Close Alley in Block 397, Bakersfield. A petition presented by the Kern County Union High School, asking that the alley running east and west tl~ough Block 397 Bakersfield be closed, was read and upon a motion by Siemon, seconded by Smith, the matter was referred to the City Attorney to investigate and if found regular, to prepare a Resolution of Intention covering. Invitation from San Francisco Board of Supervisors to Attend Conference on Liquor Regulation Legislation. An invitation extended by the San Francisco Board of Supervisors to attend a Conference in San Francisco, beginning January 25th., to discuss needed Legislation pertaining to Liquor Control, was read and upon a motion by ~alters, seconded by Boden~ was accepted and ordered placed on file. Bakersfield, California, January 22, 1934. Proposed Ordinance Creating Office of Co~mmissioner of Public Utilities & Franchises Referred Back to City Attorney for Redrafting. It was moved by Councilman Siemon, seconded by Councilman Walters, that Ordinance No. 427 New Series, creating the office of Commissioner of Public Utilities and Franchises, be adopted as read. The salary to be fixed at $200.00 per month. The motion was then withdrawn, and upon a motion by Boden, seconded by Sollets, the Ordinance was referred to the City Attorney for redrafting~ by the following vote: Ayes: Boden, Gist, ~mith, Sollers, Wilson. Bakersfield, California, January 29, 1934. Minutes of the Regular ~eeting of the Cot~ncil of the City of Bakersfield, California, held in the Council Chamber of the City Hall at eight olclock P.M. January 29, 1934. Present: Boden, Gist, Siemon, Smith, Sollers, Walters, Wilson. Absent: None. Minutes of the Regular Meeting of January 22, 1934 were read and approved as read. Hearing on Re-assessment of Street District No. 503. The City Clerk notified the Council that this was the time and place fixed by the said Council to hear objections to the re-assessment made to cover the costs and expenses contsined in the assessment roll recorded Way 25th, 19£5, for the improvement of Twenty-fourth Street in said City, from ,t~,, Street to a line twelve (12) feet west of the center line of Union Avenue, and which re-assessment was made pursuant to a resolution and order of the said Council adopted October 9th, 1935 and also pursuant to the decision of the Supreme Court of the State of California in the case of Cowart vs. Union Paving Company, 216 California p. 375. The Clerk also reported that notice of said hearing had been duly and regularly published by five (5) insertions in "The Bakersfield Californian", in the manner and within the time required by law, anm that more than twenty (20) days had elapsed since the date that the Superintendent of Streets presented the re-assessment to the Council of the City of Bakersfield, and that the Council had now acquired jurisdiction to proceed with the hearing. Three (3) written protests to the re-assessment at this time were read. One (1) submitted by Attorneys Glen D. Aldrich, Henry C. ~ack and J. R. Dorsey on behalf of seventeen (17) property o~ers, owning properties in the ~riginal Listrict and two (2) petitions signed by eighty-nine (89) OWners of properties in the Enlarged District and upon a motion by Boden, seconded by Sollets, the three (3) petitions were received and ordered placed on file for future reference. Bakersfield, California, January 29, 1934. The Mayor then invited all interested persons to present oral objections against the re-assessment. Attorneys J. R. Dorsey ~ Henry C. Mack submitted oral objections to the re-assessment on behal£ of their clients. After some discussion, upon a motion by Boden, seconded by Sollers, the hearing was adjourned until 7:30 o~clock P.M. Tuesday February 6, 1934. Application From Veterans of Foreign Wars for Free Permit to Hold Carnival. An application was made by a representative of the Veterans of Foreign Viars for a free permit to hold a Carnival in the City, and upon a motion by Siemon, seconded by Smith, action on this matter was deferred for one week. Adoption of Resolution of Intention No. 614, to Close Alley in Block 397, Bakersfield. Upon a motion by Walters, seconded by Siemon, Resolution of Intention No. 614, proposing to close the alley in Block 397, Bakersfield was adopted as read by the following vote: Ayes: Boden, Gist, Siemon, Smith, Sollers, Walters,~'ilson. ~oes: None. Absent: None. Adoption of Resolution Authorizing City Manager to Lease Sewer Farm for Pasturage. Upon a motion by Wilson, seconded by Smith, a R~solu- tion authorizing the City Manager to lease the City Sewer Farm for pasturage was adopted as read by the following vote: Ayes: Boden, Gist, Sicmort, Smith, Sollers, Walters, ~ilson. Noes: None. Absent: ~one. City Manager to Present Plan Covering Reclamation of City Sewer Farm. Upon a motion by Siemon, seconded by Boden, the City ~anager was instructed to present to the Council a plan to cover the reclamation of the City Sewer Farm. Bakersfield, almfornla, January 29, 19~4. Recommendation from Bakersfield Chamber of Commerce to Reconstruct Union Avenue Subway to a Width of 60 Feet. A communication from the Bakersfield Chamber of Commerce, recommending that the Union Avenue Subway under the Santa Fe Tracks be reconstructed to a width of sixth (60) feet, was read and upon a motion by Siemon~ seconded by Boden, the matter was referred to the City Engineer with instructions to ascertain how this project is to be financed. Petition from Veterans of Foreign Wars for Free Permit to Hold Carnival, Denied. Upon a motion by Siemon, seconded by Smith, an application placed by the Veterans of Foreign ~ars for a free permit to hold an outdoor Carnival in the City was denied on the grounds that the issuance of same would be in conflict with present City Ordinances. Petition to Open "I" Street from 30th. Street North to New State Highway, Referred to Planning Commission. A petition signed by 32 property cymers on "I" Street, asking that "I" Street be opened from 30th Street to the New State Highway was read, and upon a motion by Siemon, seconded by Wilson~ the petition was referred to the City Planning Commission for recommendation. City Attorney to Investigate Case of Automobile of Individual Colliding V~ith Fire Apparatus. Upon a motion by Boden, seconded by Siemon, the City Attorney was instructed to investigate case of Automobile of individual colliding with Fire Apparatus on January 28, 1934 and to report his findings and recommendations to the Council. City ~anager to Present Data on Fro- posed Construction of Building on City Hall Jail Site. Upon a motion by Boden, seconded by Siemon~ the City ~anager was instructed to obtain data on the proposed construction of a Duilding to be located on the City Hall Jail Site to be used by the Folice Department. on this motion. Minutes of a continued hearing before the Council of the City of Bakersfield, California~ held in the Codicil C~amber of the City Hall at 7:50 o'clock P.M. Tuesday, February 6, 19~4 for the purpose of considering objections to a re-assessment filed with the Council on January 2, 1934, to cover the improve- ment of a portion of 24th Street, from "~,, Street to Union Avenue, kno~m as Street District No. 503. Present: Boden, Gist, Siemon~ Smith~ Sollets, ~aiters, ~ilson. Absent: ~one. Proposal to Reduce Front Foot Assessment on Properties Along 24th Street in 0rig- inal District No. 503. The Mayor at this time invited further appeals or objections to the re-assessment of Street District No.. 503, and no further objections or appeals having been presented, it was moved by Siemon, seconded by Wilson, that the front ik~otage assessment on properties along 24th Street included in the orig- inal assessment be reduced from ~4.765019 per front foot to ~1.765019 per front foot and that the difference caused by this change be proportionately spread over the balance of re-assessment zstrmct. After some discussion on this motion, it was then moved by Boden, seconded by Smith, that the question be laid on the table. The motion to lay on the table was carried without any dissenting votes. Proposed Gas Regulation Orminance Referrem to Committee. ~r. L. ~. Hendsch appeared beI'ore the Council and presented a proposed Gas Regulation 0rOinance and recommended that same be approved. Upon a motion by Walters, seconaed by Boden, the ~ayor was requested to appoint a cormmittee of three to consider the matter, with instructions to report back to the Council. The Mayor appointed Councilmen Smith, ~alters and Lilson on this committee. Reappointment of Dr. P. J. Cz~eo as Trustee of Dr. Morris ~osquito Abatement District. Upon a motion by Boden, seconded by ~ollers, Dr. P. J.Cuneo was reappointed a Member of the Board of Trustees of the Dr. ~orris ~osquito Abatement District for ~ two year term. Protest from ~:edge ~dvertising Service Against Certain ~dvertising in Business District. A communication from Kedge Advertisin~ Service, protesting certain methods of advertising in the business district of the City, was read and upon a motion by Boaen, seconded by ~alters, the protest was received and ordered placed on file. Bakers£ield, Cali£ornia, February 13, 1934. Communication from State Depsrtment of Public ~orks re-proposed Widening of Union ~venue Subway. A communication from the State Department of Public Works, relative to the recommended widening of Union Avenue Subway to a width of 60 feet, was read and upon a motion by ~alters, seconded by Sollets, the communication was received an~ ordered placed on file and the City Clerk instructed to advise the State Department of ~ublic ~orks that the Council recommends that the roadway of the underpass be widened to a width of 44 feet. Action on Request from State Veterans' Welfare Board to Cancel Taxes, Deferred. A request submitted by the State ¥eterans~ %~elfare Board~ asking that taxes be cancelled on two pieces of property for the year 1932-33,was read and upon a motion by Walters, seconded by Wilson, action on this matter was aeferred until such time as the State Board replies to two communications addressed to them in connection with this request. Reception 'of City Treasurer~s Financial Report for January, 1934. Upon a motion by Boden, seconded by Smith, the City Treasurer's Financial Report for the month of January~ 1934 was received and ordered placed on file. Recommendation from City Welfare Board re-Additional Lighting in Parks. Mrs. Narsa Voorhies, representing the Welfare Commis- sion, appeared before the Council and recommended that additional lights be installed in the several parks and also suggested that a certain area in Central Park, adjacent to Childrents~playground, be restricted to use by the parents of children. A request was made to the Council to move an existing light in Jastro ~ark to a place suitable for lighting the Horse Shoe Court. This being the time set to further consider a proposal submitted by Attorney J. Keoneth Lilly, on behalf of Tod Nosier, to lease the N. W.~ of Section 10-30-28 of the Sewer Farm for oil drilling purposes, Nr. Lilly again appeared and submitted a proposed lease and stated that if the agreement was entered into no assignment wo~uld be made by Nr. Nosier except to a Corporation with net assets of more than Fifty Nillion ($50,000.000.00) Dollars. The City Nanager recommended to the Council that in his opinion if the Sewer Farm was leased for oil drilling purposes it should be divided into two strips of land ~ Nile wide and ~½ Niles long, running north and south and that either of these strips could be leased and the other strip retained. Residents of the City Requested to Cooperate in the Matter of Needless Use of Vfater. Upon a motion by Walters, seconded by Wilson, the City Council went on record as requesting the residents of the City to cooperate in the matter of not wasting water by allowing open hoses to be used without nozzles, and also calling their attention to the fact that this practice is prohibited by a ruling of the State Rail- road Commission, and the reporters present were requested to give this matter sufficient publicity. City ~ttorney Instructed to Prepare Resolution re-Appropriation to League of California Municipalities on 1935 State Legislation. Upon a motion by Bbden~ seconded by Walters~ the City Attorney was instructed to prepare a Resolution in line with a suggested Resolution prepared by the League of California Municipalities covering an appropriation of Seventy Five ($75.00) Dollars to be used to undertake and carry forward activity in support of State Legislation beneficial to Municipalities, if in Mr. Osborn's opinion this appropriation can legally be mades this Resolution to be submitted to the Co~cil next Tuesday night for their consideration. Councilman Siemon read to the Council extracts from the transcrip on appeal in the matter of Otis Hymer vs.~e Council of the City of Bakersfield, in connection with contract covering official advertising for the Fiscal Year ending June 30,193~, arid made a motion that the contrs.ct awarded the Bakersfield Califorr~ian to perform the work be rescinded. There was no second tc the motion and upon a motion by Boden, seconded by Walters, the City Attorney was instructed to prepare an opinion as to whether or not any action is necessary at this time. Legal Opinion Filed in Connection with Rejection of Bid of Superior Oil Co. to Lease a Portion of Sewer Farm for Oil Drilling Purposes. A legal opinion prepared by Attorney Frederick W. Welsh stating that in his opinion the action of the Co~mcil on October 29, 19~4 in rejecting an offer submitted by the Superior Oil Company to lease a portion of the Sewer Farm for Oil Drillir~ purposes was legal, was submitted and upon a motion by Siemon, seconded by Boden, same was accepted and ordered placed on file.. Demand of Attorneys for Superior 011 Company to Accept Offer to Lease a Portion of Sewer Farm for Oil Drilling Purposes. A communication addressed to the Council by Attorneys Borton & Petrini, representing the Superior Oil Company, demanding that the Council carry out the terms of an alleged agreement with the Superior Oil Company, pertaining to the proposed leasing of a portion of the Sewer Farm for Oil Drilling purposes, was read and upon a motion by Wilson, seconded by Smith, the communication was received and ordered placed on file. Bakersfield, California, November 13, 1934. Appropriation of $150.00 to Help Bakers- field Better Housing Committee Carry Out Provisions of Federal Housing Act. Upon a motion by Siemon, seconded by Wilson, the City Auditor was authorized and instructed to issue a warrant in the sum of $150.00 from the General Fund, in favor of C. ~. Hislop, Chairman of the Bakersfield Better Housing Committee, to be used in connection with a Kern County appropriation of $350.00 for office rental, furnishings and supplies to enable the local committee to make a survey of Kern County Homes in need of repairs and reconditioning under terms of the Federal Housing Act. City Engineer to Furnish Estimate of Cost of Widening Baker Street from East 19th Street to Niles Street. Upon a motion by Boden, seconded by Wilson, the City Engineer was instructed to make a survey and prepare an estimate of the cost of widening Baker Street six (6) feet from East 19th. Street to Niles Street. Recommendation Submitted by City Planning Commission re-Proposed Tree Planting Ordinance. A communication from the City Planning Commission, approving the purpose of a proposed Ordinance, submitted by the Bakersfield Garden Club, pertaining to the planting, removing and trimming of Trees in parking spaces, was read and upon a motion by Siemon, seconded by Walters, the matter was referred to the City Manager for further suggestions. Reception of City Treasurerrs Financial Report for October, 1934. Acceptance of Proposal of Chas. H. Peter- sen & Co. to Make Semi-Annual Audits For Periods Ending December 31, 1934 & June 30, 1935. Upon a motion by Boden, seconded by Siemon, a proposal submitted by Chas. H. Petersen & Co., offering to make the next two semi-annual audits for periods ending December 31, 1934 and June 30, 1935 for $245.00 for each audit was accepted. City Attorney Again Requested to Submit Opinion on Licensing of Public Utilities Effective January 1, 1935. Upon a motion by Siemon, seconded by Smith, the City Attorney was again instructed to furnish the Council with an opinion pertaining to the Licensing of Public Utilities by the City under the provisions of the"Riley Stewart Tax Plan", effective January 1, 1935. This being the time set to take further action on proposals submitted, covering the proposed purchase by the City of one Sedan Automobile for use in the Police Department, the City Manager submitted a recommendation as to why in his opinion the proposal submitted by Brown-Boyd Motor Company offering to furnish One Terraplane Six Sedan Automobile for a net total amount of $?68.65 was the lowest responsible proposal submitted. Upon a motion by Walters, seconded by Boden, the proposal sub- mitted by the Brown-Boyd Motor Company offering to furnish One Terraplane Six Sedan Automobile for a net total amount of $?68.65 in the opinion of the Council being the lowest responsible bid submitted, considering the merits of all automobiles offered and the adaptability to the purpose for which the car is intended, was accepted and all other bids rejected with no dissenting votes. Engineer & Health Officer to Make Recom- mendation re-Sewer to Serve Residents on Blanche Street. NIGHBERT City Manager with full authority to accept and agree to the conditions as outlined in the application for S. E. R. A. Project No. ---- Entitled "FILLING OF TRAFFIC CIRCLE AND GRADING OF "M" STREET, "P" STREET AND 23rd STREET AND "D" STREET IN THE CITY OF BAKERS- FIELD" under the State Emergency Relief Administration (S.E.R.A.) in the State of California and that a certified copy of this Resolution empowering and directing FB~D W. ~IGHBERT to make and file a request for this S. E. R. A. project should accompany this application. City Attorney to Prepare Ordinance Requiring Permits to Erect Poles in All Areas of the City. Upon a motionby Siemon, seconded by Wilson, the City Attorney was instructed to amend Ordinance No. 80 to provide that permits must be obtained by Public Utilities before erecting other Poles to be used for telephone, telegraph or/ wires in any of the streets or alleys in any section of the City. City Attorney was also instructed to investigate as to whether or not Public Utilities are required to obtain permits for any construction work of any nature in streets and alleys and if not to provide proper regulations in the proposed ordinance to cover. Complaint re-Conduct of Persons Attending Mexican & Negro Dances at ~abor Temple. A complaint was orally presented by a resident in the vicinity of 22nd & I Streets relative to alleged improper conduct on the part of persons attending Mexican & Negro Dances frequently held in the Labor Temple, and upon a motion by Boden, seconded by Walters, the matter was referred to the City Manager with instructions to contact Labor Temple Authorities and the Police Department and report his findings to the Council. Protest from Kern County Labor Council & Restaurant Owners re- Serving of Meals by Churches. Protests were filed by Kern County Labor Council and the Secretary of the Cooks and Waiter's Union on behalf of restaurant owners, relative to the Churches of the City making a practice of serving meals to different organizations and conventions, other than their own members, without paying the city license and without renumerating their help, and a~ motion by Siemon, seconded by Walters, to refer the matter to the City Attorney,was lost. Opinion from City Attorney Relative to Levying a Business License on Public Utilities Effective January l, 1935. A comm~mication from the City Attorney stating that in his opinion the City of Bakersfield may levy a Business License on Public Utility Companies, effective January l, 1935, was read and upon a motion by Siemon, seconded by smith, the City Attorney was instructed to prepare an amendment to the License Ordinance to provide for such a license if in his opinion it is necessary that the Ordinance be changed to cover.
