(a 0 0 a - 10 A RESOLUTION OF THE BAKERSFIELD REDEVELOPMENT AGENCY REGARDING THE USE OF HOUSING SET-ASIDE MONIES FROM THE DOWNTOWN BAKERSFIELD AND SOUTHEAST BAKERSFIELD REDEVELOPMENT PROJECT AREAS TO THE OLD TOWN KERN - PIONEER REDEVELOPMENT PROJECT AREA. WHEREAS, the Community Redevelopment Law of the State of California (Health and Safety Code Section 33000 et.seq.), (the "Law"), imposes specific obligations on each redevelopment agency to respond to housing needs within their jurisdiction, including, but not limited to, establishment of a Low- and Moderate-Income Housing Fund (the "Fund"); and WHEREAS, Section 33334.2 of the Law provides that the redevelopment agency shall use not less than twenty percent (20%) of all taxes which are allocated to it for the purposes of increasing, improving, and preserving the community's supply of low- and moderate-income housing; and WHEREAS, Section 33334.2 (g) also provides that a redevelopment agency may use these funds inside or outside the project area where they were collected upon a resolution of the agency and the legislative body that such use of funds will be of benefit to another redevelopment project area; and WHEREAS, there is a need in the City of Bakersfield (the "City") for decent, safe and sanitary housing and particularly for housing affordable to low-income families who work in the central city; and WHEREAS, a number of conditions limit the ability of the Bakersfield Redevelopment Agency ("Agency") to provide residential development in the Downtown Bakersfield and Southeast Bakersfield Redevelopment Project areas, such as the existing commercial land uses, socio-economics, and land suitable for a residential family housing development is limited for new construction of housing projects in the central city; and WHEREAS, there is very little housing available to low-income families (80% and below of the median income) in or in close proximity to the Downtown Bakersfield; and WHEREAS, the Baker Street Village Project, Phase 1 ("the Project") is partially completed and has been halted due to infeasible economic conditions; and WHEREAS, the Project is located in the Old Town Kern - Pioneer Redevelopment Project Area close to the Downtown Bakersfield and Southeast Bakersfield Redevelopment Project areas; and FAG NCY Page 1 of 3 Pages - GINAL WHEREAS, the Housing Authority of the County of Kern ("Housing Authority") has agreed to complete the construction of the Project to house low-income families; and WHEREAS, the Project will benefit the Downtown Bakersfield and the Southeast Bakersfield Redevelopment Project Areas by providing decent, safe and sanitary housing in close proximity to the downtown and southeast Bakersfield, where such housing is not available. WHEREAS, the City Council can provide more people affordable housing opportunities by allowing the use of the Fund outside the Downtown Bakersfield and Southeast Bakersfield Redevelopment Project Areas; and WHEREAS, Funds from the Old Town Kern-Pioneer Project Area are currently available and will provide construction assistance in the amount of $500,000 from housing set-aside funds for the Project; and WHEREAS, Downtown Bakersfield Funds in the amount of $1,883,484 can be committed to assist the Project; and WHEREAS, Southeast Bakersfield Funds in the amount of $2,550,000 can be committed to assist the Project. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD as follows: 1. The above recitals are true and correct. 2. The use of Funds from the Downtown Bakersfield Redevelopment Project Area and Southeast Bakersfield Redevelopment Project Areas outside the two redevelopment project areas will benefit the Old Town Kern - Pioneer Redevelopment Project Area, specifically the Baker Street Village Project, Phase 1. 3. The City Council allocates $1,883,484 from the Agency's Downtown Bakersfield Redevelopment Project Area Low- and Moderate-Income Housing Fund to be used to assist the Housing Authority, in the construction of 37 units in the Baker Street Village, Phase I complex to be occupied by low-income families. 4. The City Council allocates $2,550,000 from the Agency's Southeast Bakersfield Redevelopment Project Area Low- and Moderate-income Housing Fund to be used to assist the Housing Authority, in the construction of 37 units in the Baker Street Village, Phase I complex to be occupied by low-income families.
