SUBJECT: Discussion Regarding Language for Proposed Ballot Measures
RECOMMENDATION: Council determination.
BACKGROUND:
At the last regular City Council meeting on January 27, 2010, Vice Mayor Scrivner directed staff to
prepare propositions for the June election regarding pension benefits for future employees.
Specifically, Vice Mayor Scrivner directed the City Attorney's office to draft a measure which
would implement a retirement allowance for future Safety Employees at 2% at 50 and 2% at 55 for
future Non-safety Employees.
In addition, Coucilmember Couch directed the City Attorney's office to draft ballot language
which would implement a retirement allowance for future Safety Employees at 2% at 55 and 2% at
60 for future Non-safety Employees and ballot language that would require all future employees to
pay their full share of their EPMC.
In order to fulfill the direction of both Councilmembers, the City Attorney's office drafted a variety
of sample ballot measures and. ultimately narrowed it down to those included in the attached
memorandum. As you can see, the first set addresses future Safety employees, the second set
addresses future Non-safety Employees and the last sample is proposed EPMC language. There
are a variety of ways that each of these draft measures can ultimately be stated. The purpose of
today's meeting is to get clear direction from Council as to how the measures should be worded.
On February 17, 2010, City Council will have an opportunity to vote on a Resolution calling the
election. February 17th is the last opportunity that Council will have to call for the election in order
to make the June 8th ballot. The ballot measures must be in their exact form by the end of the City
Council meeting on February 17th and all of the implementing ordinances in final form. Sample
ordinances are also attached to this Administrative Report for your review, comment, and
discussion at the Special Meeting.
