RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD
APPROVING THE PROVISION OF ASSISTANCE BY THE BAKERSFIELD
REDEVELOPMENT AGENCY FOR THE INSTALLATION OF PUBLIC
IMPROVEMENTS RELATED TO THE RABOBANK ARENA AND
CONVENTION CENTER PROJECT AND THE 18TH AND EYE STREET
PARKING STRUCTURE PROJECT (DOWNTOWN REDEVELOPMENT
PROJECT AREA).
WHEREAS, the City of Bakersfield, by Ordinance No. 2033, adopted the
Downtown Redevelopment Plan and Project (the "Project") for the Downtown
Redevelopment Project Area ("Project Area") on August 14, 1972 and amendments,
November 25, 1974, August 30, 1976, and December 12, 1979; and
WHEREAS, the Bakersfield Redevelopment Agency ("Agency"), is implementing
the Plan, pursuant to the California Redevelopment Law, and is receiving tax increment
from the Project Area; and
WHEREAS, the City of Bakersfield seeks the installation of improvements to two
public facilities known and the Rabobank Arena and Convention Center and the 18th
and Eye Street Parking Garage to install related improvements on the Property
(collectively known as the "Projects"); and
WHEREAS, the Implementation Plan for the Downtown Redevelopment Project
Area contains a section entitled Capital Improvements Plan, wherein it is stated that the
Project Area through the use of redevelopment funds upgrade the existing aged
and/or deteriorated infrastructure systems including public buildings; and
WHEREAS, Health & Safety Code Section 33445 requires that a redevelopment
agency may, with the consent of the legislative body, pay for all or a part of the value
of the cost of the installation, and construction of any building, facility, structure, or
other improvement which is publicly owned, if the legislative body makes certain
findings; and
WHEREAS, Health & Safety Code Section 33679 requires that the legislative body
hold a public hearing before a redevelopment agency commits to use a portion of tax
increment for the purpose of paying all or a part of the value of land for, assists in the
development of a public facility, and/or the cost of the installation and construction of
any publicly owned building; and
WHEREAS, pursuant to Health & Safety Code Section 33679, the City and Agency
made available to the public a Summary Report on the Projects, dated January 31,
2011 ("Summary Report"), which includes; (a) a description of the Rabobank Arena and
Convention Center Project and 18th and Eye Street Parking Structure Project; (b) a
explanation of the sources of public funds necessary to finance the development of the
Project, including an estimate of the amount of taxes proposed to pay for

development of the Project; (c) facts supporting the determinations to be made by the
City herein; and (d) an explanation of why the Projects will assist in the elimination of
blight and primarily benefit the Downtown Redevelopment Project Area; and
WHEREAS, pursuant to Health & Safety Code Sections 33431, 33434 and 33679,
the public hearing was advertised once a week for two successive weeks in a
newspaper of general circulation in the community prior to the hearing; and
WHEREAS, Health & Safety Code Sections 33445 and 33678 requires that the City
Council make certain findings with respect to the provision of redevelopment agency
assistance for publicly owned improvements; and
NOW, THEREFORE, BE IT RESOLVED:
Section 1, Providing the installation of public improvements to upgrade or
replace the existing aged and/or deteriorated public facilities is an important goal
identified in the Downtown Bakersfield Redevelopment Plan and its Implementation
Plans as a means of eliminating blight. The Community Redevelopment Law provides
the Agency with the authority to ameliorate blighting conditions and to convey
property to public bodies for public purposes.
Section 2. The City Council of the City of Bakersfield hereby finds and
determines:
A. The proposed Rabobank Arena and Convention Center and 18th and Eye
Street Parking Structure Projects are of primary benefit to the Downtown
Bakersfield Redevelopment Project Area,
B. No other reasonable means of financing the Projects are available to the
community,
C. The payment of funds for the installation of improvements to the publicly
owned facilities consisting of the Rabobank Arena and Convention
Center and 18th and Eye Street Parking Structure Projects will assist in the
elimination of one or more blighting conditions inside the Downtown
Bakersfield Redevelopment Project Area,
D. The Agency shall use up to $564,700 from the Agency's Tax Increment
Fund to be used to fund a portion of the improvements to the Rabobank
Arena and Convention Center and the 18th and Eye Street Parking
Structure.
E. The Implementation Plan for the Downtown Bakersfield Redevelopment
Project contained a Capital Improvements Plan which identified the
removal of blighting influences through the installation of improvements to
public facilities a goal of the Redevelopment Agency and the
community.

F. The Rabobank Arena and Convention Center Project and the 18th and
Eye Street Parking Structure are in compliance with, and such tax
increment use is consistent with, the Downtown Redevelopment Plan and
its Five Year Implementation Plan
HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting thereof held on

SUMMARY REPORT
Pursuant to Section 33679
of the California Community Redevelopment Law
on the proposed
Improvements to the Rabobank Arena and Convention Center
and the 18th and Eye Street Parking Structure
INTRODUCTION
The California Community Redevelopment Law (Health & Safety Code
Sections 3300 et sea.) allows redevelopment agencies, with the consent of the
legislative body, to pay all or a part of the cost of the installation and construction of
any building, facility structure, or other improvements that is publicly owned and is
located inside or contiguous to the project area, if the legislative body determines all
of the following:
(1) That the acquisition of land or the installation or construction of the
buildings, facilities, structures, or other improvements that are publicly
owned are of benefit to the project area by helping to eliminate blight
within the project area or providing housing for low- or moderate-income
persons;
(2) That no other reasonable means of financing the acquisition of the land
or installation or construction of the buildings, facilities, structures, or other
improvements that are publicly owned, are available to the community;
and
(3) That the payment of funds for the acquisition of land or the cost of
buildings, facilities, structures, or other improvements that are publicly
owed is consistent with the implementation plan adopted pursuant to
Section 33490.
As part of the public hearing process, a Summary Report is required to be
prepared, and be made available for public inspection and copying, which contains
the following information:
(a) Estimates of the amount of the taxes proposed to be used to pay for the
land and construction of any publicly owned building, including interest
payments.
(b) Sets for the facts supporting the determination required to be made by
the legislative body pursuant to Section 33445 or the findings required to
be made by the legislative body pursuant to Section 33445.1; and

(c) Sets for the redevelopment purpose for which the taxes are being used
to pay for the land and construction of the publicly owned building.
This Summary Report outlines the significant parts of the proposed
improvements to the publicly owned facilities - Rabobank Arena and Convention
Center and the 18th and Eye Street Parking Structure. The Summary Report also
describes the proposed manner of financing the Projects, including the amount of
tax increment dollars involved, as well as the lack of reasonable alternative means of
financing. Finally the Summary Report describes the redevelopment purposes
achieved by these two projects.
This Summary Report is based upon information regarding the projects and
other Bakersfield Redevelopment Agency and City Council Resolutions described
below. The Summary Report is organized into the following six sections.
1. Description of the Proposed Projects - This section includes descriptions of each
project and if any, major financial responsibilities of the Agency and the City.
2. Description of the Benefits to the Project Area from the Projects - This section
discusses how the proposed projects will primarily benefit the Downtown
Project Area, and also benefit the neighboring environs.
3. Lack of Reasonable Alternative Means of Financing the Projects - This section
describes the methods of financing proposed for the Projects and explains why
there are no reasonable alternative means of financing the Project without
Agency assistance. Also included in this section are the estimates of taxes and
tax increment monies to be used to pay for the projects.
4. Elimination of Blight - This section provides an explanation of how the Project
will assist in the elimination of blight in the Downtown Redevelopment Project
Area.
5. Consistency with the Implementation Plan - This section includes an
explanation of how the Projects are consistent with the goals and objectives of
the Downtown Bakersfield Project Area Implementation Plan.
II. DESCRIPTION OF THE PROPOSED PROJECTS
The improvements to the Rabobank Arena and Convention Center located at
1000 Truxtun Avenue shall consist, but not be limited to, the replacement of the
dilapidated boilers used for heating of the facility, lighting retrofit, abatement of
asbestos, and the removal and replacement of a transformer. The equipment being
replaced is antiquated and aged from twelve to fifty years. The old equipment is not
up to either EPA nor San Joaquin Valley APCD standards and must be replaced. The
installation of the improvements will provide for the elimination of blight within the
Downtown Redevelopment Project Area by the removal of a dilapidated boiler cj, (i KF9

the retrofit of existing lighting to provide safety for the community at the publicly
owned facility.
The improvements to the 18th and Eye Street Parking Garage located at 1600
18th Street, shall consist, but not be limited to, the installation of security cameras in
the publicly owned facility. The cameras installed will protect the community from
theft and vandalism and provide for the elimination and deterrence of blight within
the Downtown Redevelopment Project,
The financial investment to assist in the improvements to the projects from the
Bakersfield Redevelopment Agency will be $564,700
III. DESCRIPTION OF THE BENEFITS TO THE PROJECT AREA FROM THE PROJECTS
The Downtown Project Area shall benefit from both projects by the elimination
of blighting conditions to two publicly owned facilities. The replacement of the
dilapidated boilers and lighting retrofit at the Rabobank Arena and Convention
Center will further better serve the public and surrounding community by ensuring the
removal of blighting influences within the downtown area.
The installation of security cameras at the 18th and Eye Street Parking Garage
will assist in the elimination of blight by deterring vandalism and graffiti in downtown.
The public facility provides parking to employees and clients of nearby businesses.
The cameras will ensure the deterrence of blighting influences within the downtown
area.
IV. LACK OF REASONABLE ALTERNATIVE MEANS OF FINANCING THE PROJECTS
The City and Agency have worked cooperatively in leveraging local public
dollars to the maximum. The challenge in financing projects in the current economic
conditions continues. The budget not only locally but statewide continues to be an
issue in financing projects; including those that benefit the public through the
elimination of blight. No other reasonable means of financing or City funds are
available at this time to finance the Projects from the City,

V. ELIMINATION OF BLIGHT
The Agency adopted the Redevelopment Plan for the Downtown Bakersfield
Redevelopment Project in August of 1972, and amended in 1974, 1976, and 1979 for
the specific purpose of eliminating blighting influences within the 225 acres the
Project covers. Goals and objectives within the Redevelopment Plan include the
rehabilitation or installation security devices to eliminate blighting influences to public
facilities.
VI. CONSISTENCY WITH THE IMPLEMENTATION PLAN
The Implementation Plan for the Downtown Bakersfield Redevelopment Project
Area states that taken together, the projects described above will encourage the
cooperation and participation of Project Area property owners, public agencies,
and community organizations in the elimination of blighting conditions and the
promotion of new or improved development in the Project Area. In addition, the
Implementation Plan, subject to appropriate Agency and City findings for the use of
redevelopment funds, states Capital Improvements to public infrastructure and
facilities projects that involve construction and installation of public improvements to
upgrade the existing aged and/or deteriorated infrastructure systems including
public buildings and facilities is necessary for effective redevelopment of the Project
Area.
