RR 006- 1 029- 11 A RESOLUTION OF THE BAKERSFIELD REDEVELOPMENT AGENCY APPROVING A COOPERATION AGREEMENT WITH THE CITY OF BAKERSFIELD REGARDING THE TRANSFER OF CERTAIN AGENCY- OWNED PROPERTIES TO THE CITY AND AUTHORIZING THE CITY TO ACT AS THE AGENCY'S AGENT IN THE DISPOSITION AND REDEVELOPMENT OF SAID PROPERTIES IN ACCORDANCE WITH CALIFORNIA REDEVELOPMENT LAW WHEREAS, the City Council of the City of Bakersfield (the "City Council") established the Southeast Bakersfield Project Area in the City of Bakersfield, as well as the Redevelopment Plan for the Old Town Kern - Pioneer Project Area in the City of Bakersfield, both of which were approved by the City Council on June 30, 1999, pursuant to Ordinance No.'s 3905 and 3904, respectively, (collectively, "Redevelopment Plans"); and WHEREAS, the intent of each of the Redevelopment Plans is, in part, to provide for the construction and installation of necessary public infrastructure and facilities and to facilitate the repair, restoration and/or replacement of existing public facilities and to perform specific actions necessary to promote the redevelopment and the economic revitalization of each of the Project Areas; to eliminate blight; and to increase, improve and preserve the community's supply of low and moderate income housing, some of which may be located or implemented outside of the Project Areas; and to take other necessary actions to implement the Redevelopment Plans and to accomplish the goals and objectives of the Redevelopment Plans; and WHEREAS, the Bakersfield Redevelopment Agency ("Agency") has adopted a Five-Year Implementation Plan for each of the Project Areas (the "Plan") with established goals of economic development, community revitalization, commercial revitalization, institutional revitalization and supporting affordable housing. To implement the programs and activities associated with these goals, the Agency has acquired real property within each of the Project Areas to be redeveloped; and WHEREAS, pursuant to California Health & Safety Code Section 33220, a portion of California Redevelopment Law ("CRL"), certain public bodies, including the City, may aid and cooperate in the planning, undertaking, construction, or operation of redevelopment projects; and rr F- r v C QRIGINAI 01099/0012/93560.3 WHEREAS, accordingly, at this time, the Agency desires to transfer certain parcels of real property to the City, as Agency's agent, along with the responsibility of implementing the Redevelopment Plan applicable to each parcel to bring about the redevelopment of said parcels as the City is familiar with the goals of the CRL, the Redevelopment Plans and the Implementation Plans and the City desires to cooperate with the Agency and to carry out the disposition and redevelopment of each of the "Properties" (as defined below) in accordance with the objectives and purposes of the CRL, as the CRL is written as of the execution date of this Agreement, and the applicable Redevelopment Plan and the Implementation Plan, as the City's assistance and cooperation will be necessary to implement and complete the redevelopment of the Properties for the benefit of the City, its residents and businesses; and WHEREAS, the parcels at issue are: (i) East California/SEC Owens Street, Assessor Parcel Number ("APN") 018-040-70; (ii) 1010 Baker/630 Kentucky St, APN 014-270-17; (iii) 700 California/1231 R St., APNs 006-510-06, -07 and -09, (iv) South Mill Creek Commercial, APN 006-510-04, (v) South Mill Creek Commercial, APN 006-510-11; (vi) South Mill Creek Commercial, APN 006-510-12; (vii) South Mill Creek Commercial, APN 006-480-11 and (viii) South Mill Creek Commercial, APN 006-360-18, 23 (collectively, the "Properties"; each individually a "Property"), The Property referred to as 1010 Baker/630 Kentucky St., APN 014-270-17 is in the Old Town - Kern Pioneer Project Area. The other seven Properties are within the Southeast Bakersfield Project Area; and WHEREAS, it is in the best interests of the City and Agency and for the common benefit of residents, employees, businesses, tenants and property owners within the Project Areas and the City as a whole for the Cooperation Agreement to be approved. NOW, THEREFORE, THE BAKERSFIELD REDEVELOPMENT AGENCY DOES HEREBY RESOLVE, AS FOLLOWS: Section 1, The above recitals are all true and correct and are hereby adopted as findings. Section 2. The Agency has received and heard all oral and written objections to the proposed transfer of Properties from the Agency to the City as described in the Cooperation Agreement, and to other matters pertaining to this transaction, and all such oral and written objections are hereby overruled. Section 3. The Agency hereby approves the Cooperation Agreement. Section 4, The Agency hereby approves the execution of a Grant Deed for each of the Properties. 2 y ~ 1- r U tr GRIGINAI 01099/0012/93560.3 Section 5. The Chairman and Executive Director, or their designees, are authorized and directed to take such actions and execute such documents as may be necessary to implement and affect this Resolution, the Cooperation Agreement and the Grant Deeds on behalf of the Agency, together with such non-substantive changes and amendments as may be approved by the Executive Director and Agency Counsel, Section b. The Secretary shall certify to the passage and adoption hereof. Section 7.
